Prime Minister & Cabinet
The Prime Minister is the supreme political leader and the real executive dynamo of the Republic of India:
A. Powers and Roles of the Prime Minister:
- Appointed by the President, the PM must command the confidence of the majority in the Lok Sabha.
- Acts as the sole communication bridge between the Cabinet and the President (Article 78).
- Allocates portfolios to ministers, presides over Cabinet meetings, directs domestic policies, leads the Lok Sabha, and commands foreign policy and nuclear command.
B. Collective Responsibility (Article 75):
- The Council of Ministers is collectively responsible to the Lok Sabha.
- This means all ministers "sink or swim together"! If a Vote of No-Confidence is passed against the Prime Minister or the government in the Lok Sabha, the entire Council of Ministers must immediately resign, including ministers from the Rajya Sabha.
- Cabinet secrecy and solidarity: A minister who openly disagrees with a Cabinet decision must either support it in public or resign from the government.
C. Size Limit of Council of Ministers (91st Amendment, 2003):
To prevent corrupt jumbo-cabinets designed to appease coalition partners, the 91st Amendment mandated that the total number of ministers (including the PM) shall not exceed 15% of the total strength of the Lok Sabha (approx. 81 ministers).
