A. The Tumultuous Context (1946–1949):
The Constituent Assembly met in the shadow of catastrophic national trauma:
- The horrors of Partition: communal slaughter in Punjab and Bengal, millions of traumatized refugees pouring across borders, and mass rape and dislocation.
- The Princely States Puzzle: Over 565 princely states (covering one-third of the subcontinent's landmass) were released from British paramountcy by the Indian Independence Act, legally free to join India, join Pakistan, or declare independent sovereignty! Sardar Vallabhbhai Patel undertook the monumental task of integrating these kingdoms into the Indian Union.
B. Composition of the Constituent Assembly:
- Members were indirectly elected by the newly elected provincial legislative assemblies under the Cabinet Mission Plan of 1946. The Muslim League boycotted initial sessions, so Congress members occupied 82% of the seats.
- Yet, it was a remarkably diverse ideological body comprising conservative nationalists, socialists, trade unionists, and legal titans.
- The Core Steering Six:
- 1. Jawaharlal Nehru: Moved the historic Objectives Resolution and proposed the National Flag.
- 2. Sardar Vallabhbhai Patel: Master negotiator who resolved committee reports on fundamental rights, minorities, and provincial constitutions.
- 3. Dr. Rajendra Prasad: The impartial, dignified President of the Constituent Assembly.
- 4. Dr. B.R. Ambedkar: Chairman of the Drafting Committee; brilliant legal jurist who piloted the draft constitution through intense clause-by-clause debates.
- 5. B.N. Rau: Constitutional Adviser to the Government; prepared extensive comparative research briefs on global constitutions.
- 6. S.N. Mukherjee: The Chief Draftsman capable of translating complex legal compromises into lucid constitutional language.
